Even for experienced motorcycle riders here in Louisiana and around the country, maintaining control of their vehicles is not always an easy task. When there is a loss of control, the driver and/or passenger could fall off the motorcycle and into the roadway. This eventuality led to a recent car accident in which a man was killed and a woman was injured.
On a recent Saturday night, a 43-year-old man was operating a motorcycle eastbound on Interstate 20. Somehow, he lost control and his passenger fell onto the roadway. As he was helping the 43-year-old woman up and to a safe place, a car came along and struck both of them. The man died from the injuries he suffered in the impact.
The woman suffered severe injuries and remained hospitalized in serious condition at last report. At the time of this writing, the Bossier City Police were still investigating the accident. So far, charges have not been filed.
The injured passenger could be facing a lengthy recovery during which she will more than likely incur medical expenses, lost wages and other damages. She could exercise her rights to file a personal injury claim against both the estate of the deceased driver and the driver of the car. If she is able to establish that each of them contributed to or caused the injuries she suffered, a Louisiana court might consider awarding her damages.
As for the family of the motorcyclist killed in this car accident, it may file a wrongful death claim against the driver of the car that struck him. Under the state’s comparative negligence laws, the court will assign a percentage of liability to each party involved. Any award of damages to the family will be reduced by that percentage.
