Pedestrian suffered catastrophic injuries when struck by car

At times, pedestrians are forced to put themselves in harm’s way. Even if they are careful, the unpredictability of vehicles and their drivers on Louisiana roadways makes it difficult to avoid every hazard. Pedestrian vs. motor vehicle accidents often result in the victims suffering catastrophic injuries, particularly since they are virtually unprotected.

Recently, a pedestrian suffered critical injuries after being struck by a car. Police reports indicate that the vehicle was turning left off one road onto the road the pedestrian was crossing. The accident occurred at approximately 7:10 a.m. on April 9. At last report, the victim remained hospitalized, and his or her condition was still considered critical.

Lafayette police say the driver involved was not cited in the accident. However, that does not release the driver from all responsibility. The victim retains the right to file a personal injury claim when he or she is able. If the pedestrian dies from the injuries suffered, the victim’s family may file a wrongful death suit against the driver.

It can take a significant amount of time to recover from the catastrophic injuries suffered in an accident. During that time, medical expenses and lost wages can add up quickly — especially since health insurance normally does not cover 100 percent of the costs associated with hospitalization and other medical care that may be needed during recovery. The financial toll such an accident could take on the victim could be just as devastating as his or her injuries. Few people are financially prepared for such an event. A successfully litigated civil claim in which a Louisiana court finds that the victim’s injuries were due to the negligence of another could provide the monetary restitution necessary to relieve the financial burdens that accompany such a serious accident.
