Deceased driver unsuccessfully attempted to avoid car accident

Every time Louisiana drivers get on the road, they are presented with numerous situations in which an accident could occur. Drivers are required to pay attention to their surroundings and react to any potential obstacles. Sadly, even when a driver does everything right and attempts to avoid a car accident, the outcome can still be a serious collision.

Shortly after 7:30 p.m. on a recent Sunday, the Louisiana State Police responded to an accident that occurred on LA 38. Upon arrival, they discovered two vehicles were involved in a head-on collision. The initial investigation revealed that the vehicles were heading in opposite directions on the highway.

As they approached each other, the westbound vehicle veered into the eastbound lane of travel. The driver of the eastbound vehicle attempted to avoid the collision by moving onto the shoulder, but it was not enough to keep the vehicles from colliding. The driver of the eastbound vehicle suffered severe injuries in the crash and was transported to a hospital in the area. Unfortunately, he died the next morning. Meanwhile, the westbound driver suffered only moderate injuries, and prosecutors could file charges upon review of the completed investigation.

In addition, the family of the deceased driver retains the right to file a wrongful death suit against the westbound driver. Establishing negligence on the part of the driver could mean an award of damages for the family. If they receive restitution, it could defray the expenses incurred as a result of the death of their loved one in this car accident.
